The obligation to fight even if to preserve the life of a single dhimmy

Imam al-Quraafi al-Maliki reported in his book al-Furuq the words of Ibn Hazm in his Maratib al-Ijma’ that whoever was a dhimmi and a waring party entered our country pursuing him, it is incumbent upon us to raise alms against them and die in that cause [should it be necessary] in preservation of those who are under the protection of Allah – the Almighty – and His Messenger – God bless him. To do otherwise would be to neglect the contract of alliance. He mentioned that this is supported by consensus of Umma’. Al-Quraafi commented saying: “a contract that leads to the death of human life and property in the course of its preservation is a great [contract]” (al-Quraafi, al-Furuq, vol. 3)
